  • BERGMAAN  GENERAL TERMS AND CONDITIONS FOR ONLINE SALES

    Please make sure to read these Website Sales Terms ("Sales Terms") thoroughly before purchasing any items from our website ("Products"). Along with our Privacy Policy and Terms of Use, these Sales Terms outline the agreement between you and us regarding your use of this website and any purchases made either online or by phone.     Article VI.45, the general conditions outlined below apply to all orders and sales made by any consumer at Bergmaan.

    Before submitting an electronic order via the website www.bergmaan.com, consumers must agree to these general conditions. As such, consumers cannot claim ignorance of either the existence or the content of these general conditions, which are binding for each order placed at www.bergmaan.com, notwithstanding any special conditions that might deviate and will always take precedence over the provisions of these general conditions.

    You must be over 18 to make a purchase from us.

    Orders are placed by the Customer selecting the product which he wishes to purchase and adding it to his cart by clicking on the corresponding button “Add to cart” from the product page. For rings and bracelets, the Customer selects the required size and then clicks on “Add to cart”.

    Once the Customer has selected all the products that he wishes to purchase, he must confirm the contents of the cart and place the order.

    The Customer must hold a customer account and, to this end, he must accurately provide his identity, contact details, a valid e- mail address and a password.

    You will need to choose your preferred delivery option (if any delivery fees apply, they will be added to your total and you can review them before finalizing your Order), confirm your delivery address, and enter your payment information. You can review and correct any mistakes in your Order up until you submit it by clicking the 'Complete Purchase and Pay' button.

     

    By clicking this button, you agree to our Terms of Sale.

    All orders are subject to our approval. We are not required to accept your order and may choose, at our discretion, to decline it. However, by clicking the 'Confirm Purchase and Pay' button, you agree that you are committing to pay for the Product(s) if your order is accepted by us.

    Following payment for the order, Bergmaan acknowledges receipt of the latter by sending an e-mail to the address provided previously by the Customer. 

    After we send you an acknowledgment email, we will verify our ability to fulfill your order. If we accept your order, we will confirm it by sending you a second email ("Dispatch Email"), which will confirm your order, the shipment of the Product(s) to your specified delivery address, and provide estimated delivery times. 

    This email is automatically sent to the email address you provided. At this stage, we will process the payment information you provided and charge you for your order.

    By sending the Dispatch Email, we officially confirm and accept your order, forming an agreement between us ("Agreement"). Once this Agreement is in place, we are legally obligated to provide you with the Products that meet the terms of the Agreement.

    You should carefully review both the confirmation email and the Dispatch Email to ensure all details are correct.

    If you notice any errors, please inform us right away.

    If there are any issues with your order, a representative from our team will reach out to you.

    If the product ordered by the Customer is no longer available for sale,  Bergmaan will inform the Customer, when processing the order, by e-mail to the address provided.

    The Customer will not be billed for these products.

  • A binding sale and purchase agreement between Bergmaan and the consumer is confirmed when the consumer, having agreed to the terms at  Bergmaan's webstore, finalizes an order with payment by clicking the confirmation button. The obligation to pay is established at the moment this button is pressed.

    Upon receiving payment,  Bergmaan is obligated to deliver the purchased product within the specified delivery period, regardless of any differing terms.

    The price of items of jewelry appears on the product page for each item offered for sale on the site www.bergmaan.com at the time of purchase.

    Prices are indicated in euros, inclusive of all taxes.

    Bergmaan reserves the right at any time to change the sale prices appearing on its online store.

    Delivery costs depend on the delivery destination chosen for each product offered.

    The price is payable in full and in one single payment.

    For orders outside the European Union, additional  customs duty may be incurred . These duties remain payable by the Customer.

    Payment is made online by credit card (VISA,MASTERCARD,MAESTROCARD) or by Paypal.

    Orders are considered confirmed upon receipt of full payment by the consumer.

    Delivery terms begin upon receipt of payment.

    The product offered and sold are ''custom made'' jewels, crafted from noble metals and stones chosen by the customer by measure , weight and design  based on design and photographs available on the www.bergmaan.com

    The prices listed on the website are per item and subject to change .Price may fluctuate based on consumer's specific requirements as well as daily price of the constituent materials .Therefore ,prices may vary at different times. Both the consumer and the seller are bound by the price displayed at the time of purchase .

    All prices include VAT .

  • Shipments to customer are insured by us. Return shipment should be insured by the carrier with whom the customer return goods.

    Shipments are free unless sent to exceptional destinations .In such a cases, we will provide information upfront .

    We strive to deliver the Product (s) to the delivery address specified in your order within the timeframe indicated in our Dispatch Email ,though an exact delivery date cannot be guaranteed .

    If the Product(s)are not delivered with 30 days of the Contract or any other mutually agreed date, you have right to cancel the Contract ,and we will refund any payments you have made.

    Delivery terms are specified per item ,ranging from a minimum of 5 working days (Excluding National not working days , National Holidays ) for jewelry with parts in stock to up to 30 days for jewelry requiring orders and / or created parts.

    Exceptions are made for orders placed in the last week of July and in August due the annual summer recess of raw materials suppliers. Listed delivery terms may be extended due to force majeure, which renders delivery impossible and is never the seller's responsibility .

    Force majeure occurs due to events beyond human control (e.g.,natural disasters, fire, flood, death, illness ) or acts of third parties for which the parties to the agreement are not responsible (e.g. war, strike, theft, vandalism).

     

    We only ship to following countries : Belgium ,Netherlands ,France, Germany, Austria ,Luxembourg ,Slovenia, Italy, Denmark, Finland, Poland, Portugal, Spain, Slovenia, Sweden, Hungary.

    Complaints about delivery must first be reported by telephone to  Bergmaan which will then liaise with the respective deliverer regarding the product supply.

    Product-related complaints must be reported in writing to Bergmaan at concierge@bergmaan.com.

    Complaints are generally addressed within 14 days, and resolution process always documented in writing .

    Complaints resulting from visible defects in the delivery product must be communicated to  Bergmaan by telephone or e-mail.

  • While we have made every effort to show the Product(s) as accurately as possible through the photos and images on our website, some items may appear slightly larger or smaller than their actual size due to screen settings and photography methods.

    Certain items may be shown larger to highlight details, or smaller to display the whole item.

    Additionally, details such as color, pattern, and texture may look different on your screen compared to the actual Product you receive, depending on your monitor settings.

  • While returns of custom-made and art-accompanied goods are not permissible post-delivery, we endeavor to ensure satisfaction with every piece created and delivered. In the rare event of dissatisfaction, we encourage direct communication to explore potential resolutions.

    The products offered and sold are ‘custom made’ jewels, crafted from noble metals and stones chosen by the customer by measure, weight, and design, based on designs and photographs available on the website www.bergmaan.com.

     

    Nonetheless,  Bergmaan offers the opportunity to return the purchased item(only applicable for jewelry) in exchange for a voucher on the same of equal or lower price  amount ,or another jewel same or of equal or lower price, in the latter case supplemented by a voucher. For an exchange involving a more expensive product above 1000 euros (price based on daily rates at the time of trade), additional payment will be required. Exchanges must occur within 14 days after delivery and only apply to items showing no signs of use or wear, returned in original packaging, including the authenticity certificate.

    Return costs are always the consumer's responsibility. Custom-made or engraved jewelry cannot be returned as they are personalized and unsellable.

    Gift Recipients:

    Gift recipients can either exchange the item for other merchandise, though the exchange is non-refundable, or ask for the refund to be issued to the person who purchased the Product(s). To exchange your gift or request a refund for the purchaser, simply follow the instructions provided with your package.

    Unless we offer a specific warranty for certain Product(s), or there are legal guarantees (such as the product conforming to its description), we do not provide additional warranties or guarantees for our Product(s).

    When you receive your Product(s), you should carefully check them for any damage or defects.

  • Exchange Policy 

     

    At Bergmaan, we want you to truly love your purchase. To exchange a piece bought from our website, we first need to process a refund for your original order. Because each exchange requires a new invoice, a new payment will be necessary to complete the transaction.

  •  Bergmaan  will never share consumer personal data with third parties without explicit consent.

     

    The (pre)contractual relationship between Bergmaan and the consumer is governed exclusively by Belgian law.

    Only the competent courts of the Antwerp district, Antwerp department, are authorised  to address any claims arising from the (pre)contractual relationship between Bergmaan and consumers, notwithstanding any deviating mandatory law.

    Should any clause or provision ofthese conditions be deemed invalid, unenforceable, and/or not applicable, this does not affect the validity, enforceability, and applicability of the remaining clauses or terms.

    These terms apply to all orders placed or sales made, whether by consumers (natural persons acting for purposes unrelated to their professional activity) or by businesses and professionals (acting within the scope of their trade, business, craft, or profession).

    This document has been updated to reflect the company name as  Bergmaan, with the address and details adjusted accordingly.
